One Article, Many Ordinances
Article 12 authorises local governments to adopt minimum housing ordinances. Cary, Apex, Garner, Wake Forest, Knightdale, Holly Springs, Fuquay-Varina, Morrisville, Zebulon, Wendell and Rolesville each have their own, and the county administers unincorporated areas.
The statutory machinery is identical: a finding of unfitness, a hearing, an order to repair or to remove, the fifty per cent test, the recording requirement and the abandonment provision. The full position is on our page covering the fifty per cent determination.
Then What Actually Differs Between Them?
Which Town Has Your Address
Less obvious than it sounds around here. Growth has left municipal boundaries interleaved with unincorporated county, and a postal address frequently suggests one town while the parcel sits in another or outside all of them.
The county's property record names the jurisdiction. Getting it wrong means an enquiry to an office with no file on your property, which returns a reassuring answer that means nothing.
Does the County Enforce in Unincorporated Areas?
We publish no enforcement postures, ordinance details or values for the individual Wake County towns. Each administers its own and each will state the current position for an address.
Values Keep the Fraction Low
Across much of this ring finished values are strong, which means the repair cost stays comfortably under fifty per cent of the dwelling's value even after a serious fire.
So the demolition branch is rarely reached here, and the deciding question moves onto the building. That is a more comfortable position than owners closer in are frequently in.
Later Construction Decides the Rest
Much of the housing is post-war and later, built on slab with engineered roof trusses and floor systems. Those come out whole once heat has compromised the connections rather than being repaired in sections.
Where a house sits on a slab, heat damage to it is invisible and becomes the largest unknown on the file. An inspection addressing the slab specifically is worth commissioning, because buyers discount hardest for what they cannot rule out.
Repair Frequently Wins Out Here
On strong values with a repairable frame, an owner doing the work or a rehabber will beat any cash offer, because they need a smaller margin than we do. We would rather say so at the start than negotiate toward a figure that was never competitive.

The Article Behind Every Town Ordinance
All of these ordinances are adopted under Article 12 of Chapter 160D. Section 160D-1203 sets the 50 per cent test against then current value, 90 days for demolition, and the recording requirement in the grantor index.
Section 160D-1203(6) adds the 1 year abandonment provision, and section 160D-949 governs the historic district route.
