A Finding of Unfitness Displaces People

The practical difference on let property. The determination that starts this process is that a dwelling is unfit for human habitation, and an order can require that it be vacated and closed.

Does a Fire End a Tenancy?

That depends on the lease and on North Carolina landlord and tenant law, and it is a question for a lawyer rather than for a buyer. What we can say is that it runs in parallel with the code process rather than being resolved by it, and owners who treat the two as one thing tend to get surprised by whichever they were not watching.

Vacated and Closed Starts the Clock

The provision that matters most on this side of the city, because let buildings empty out fast after a fire and then sit.

Under the abandonment of intent to repair provision, a dwelling vacated and closed for a period of one year under an ordinance adopted for that purpose, or after an order or proceedings regarding a dwelling to be repaired or vacated and closed, opens the demolition route.

An Academic Year Is Not a Long Time.

It is not, and that is exactly the risk. A building emptied in the spring, left secured over a summer while a claim is argued, and still empty the following spring has consumed most of the year without anybody making a decision. Noting the date the building was closed up is worth doing on the day it happens.

Mixed Stock, Mixed Answers

Housing here spans a wide range of eras, from pre-war closer in to much later further out, so the build year predicts more than the neighbourhood does.

Earlier dimensional framing chars and can frequently be retained where it has been kept dry. Later engineered assemblies come out whole once heat has reached the connections. Establishing yours is worth doing before assuming which market you are in.

Multiple Occupancy Complicates the Repair

Where a house has been divided or adapted for letting, the work required to bring it back into compliance may be more than restoring what burned. Conversions done under earlier expectations are not necessarily what would be permitted now.

It is worth asking the city what a restored building would have to satisfy before pricing a repair on the assumption that like replaces like.

The Provisions That Reach a Let Building

Section 160D-1203 of Chapter 160D governs orders to repair or to vacate and close, with the 50 per cent threshold measured against then current value and 90 days to demolish where it is failed.

Section 160D-1203(6) turns 1 year of a dwelling being vacated and closed into a route toward demolition, which on rapidly emptied let property is a shorter period than it sounds.
